Negligence

One factor in determining personal injury compensation is negligence. If another person or business is the cause of your injury because they were negligent, they may be liable to you for any damages that have resulted. Whether or not a party was negligent depends on the circumstances that led up to the accident. There are regulations that exist in order to prevent personal injuries from occurring, but in some instances, a person can be held responsible for their failure not to act in preventing personal injuries, whether intentional or not.

In order to determine if a personal injury was caused by someone else’s negligence, it is important to have a detailed description of the accident. Whether it is a slip and fall or an automobile accident, the information needed is the same.

If you are involved in a personal injury accident:

Get Medical Attention.
	This is extremely important, because some injuries may not be immediately apparent at the time of the accident. Seeking medical attention will give you a better idea of the extent of your injuries.
Report the Accident.
	Whether you are involved in a motor vehicle accident, or you are involved in a slip and fall, it is important to report the accident. An authority figure will not only help to organize the situation, but they will write a report. This is useful in determining who was at fault for the accident and may be used as evidence in your lawsuit. Never admit fault of your own but be sure to note if someone else admits fault for the accident.
Obtain Contact Information.
	•	Always obtain names, addresses, and phone numbers of anyone involved in an accident. If it is a motor vehicle accident, be sure to get license plate numbers, insurance policy numbers and contact information.
	•	Obtain names of anyone who may have witnessed the accident as well as the police officers, other authorities’ and\or the person who is writing a report of what happened.
	•	Note the location and time that the accident occurred and how it happened. Be sure to include all events leading up to the accident and note if someone has admitted fault to it.
	•	Make a note of all injuries announced at the scene. If you have a camera on hand, it is beneficial to take pictures at this point. Be sure to take pictures of anything that may be important in determining negligence. If it is a slip and fall, obtain a picture of the conditions at the time of the accident.
